Article 1. Purpose

These Terms of Use set the rules for using the InfraPrep website, published by Sacha Ochmiansky, sole trader (see the Legal notice). They apply to anyone who uses the website, with or without an account, with or without a subscription. The conditions of the paid subscription (price, payment, cancellation, withdrawal, guarantees) are in the Terms of Sale. If the two documents conflict on the subscription, the Terms of Sale prevail.

Article 2. Access to the website

  • Without an account. Public pages and the 25 free questions of each certification, in study mode, are available without an account.
  • With a free account. An account lets you save your results, take the practice exams available at your access level and contest an answer.
  • With a subscription. The subscription gives access to the whole catalogue during each paid period (see the Terms of Sale).

Article 3. Account

  • You must provide a valid email address and agree to give accurate information.
  • The account is personal. You keep your password confidential and are responsible for the use of your account. Tell us without delay at contact@infraprep.fr if you think someone else is using it.
  • You may close your account at any time by writing to us. [TO BE COMPLETED: deletion function in "My account", if any.] Closing the account does not automatically cancel a current subscription: cancel it first (article 7 of the Terms of Sale).

Article 4. Personal use

Access, free or paid, is granted for your personal use in preparing for a certification. The following are prohibited:

  • sharing your account: giving out your login details, letting another person use your account or using one account for several people;
  • reselling, renting or making access available to third parties;
  • scraping the content: systematically extracting, copying, saving or collecting the questions, answers or explanations, by robot, script, extraction tool or by hand, in particular to build another question bank or to train an artificial intelligence system;
  • publishing or distributing the questions, answers or explanations, in whole or in part, on another website, forum, social network or training material;
  • any attempt to bypass access limits, disrupt the website or access other users' data.

You may occasionally quote a question to contest it with us or to discuss it privately.

Article 5. Independence and origin of the content

InfraPrep is an independent service with no connection to the certification vendors. The questions are original: they are written by InfraPrep from the vendors' public documentation and do not reproduce any real exam question. Product and certification names belong to their owners and are used only to identify the exam concerned.

Wherever possible, each question links to the documentation page that supports the answer. Products change: if there is a difference, the current official documentation prevails.

Article 6. No guarantee of passing

The tests are a practice tool. They do not guarantee that you will pass the official exam. A score on InfraPrep is not a prediction of your exam score. The format, difficulty and content of the official exam are decided by its vendor and may change without our being informed.

This clause does not limit your rights if the service does not conform (article 10 of the Terms of Sale).

Article 7. "Contest this answer" button

If you think an answer is wrong, a question is ambiguous or an explanation is out of date, use the "Contest this answer" button (account required). If possible, give the link to the official documentation supporting your view and a short comment.

  • Each contest is checked against the official documentation. The question may be corrected, reworded, replaced or kept.
  • We handle each contest within 7 working days.
  • You can follow the status of your contests in your area. [TO BE CHECKED: how the status is actually shown.]
  • Do not include personal data or unlawful content. We may delete an abusive comment.

The button is there to improve the questions. It does not replace a complaint or the legal guarantee of conformity (articles 10 and 12 of the Terms of Sale).

Article 8. Intellectual property

The questions, answers, explanations, texts, badges, graphics and question database of the website belong to the publisher unless stated otherwise. Any full or partial reproduction or performance made without the publisher's consent is unlawful (article L. 122-4 of the French Intellectual Property Code). Extracting or reusing a qualitatively or quantitatively substantial part of the question database is prohibited (article L. 342-1 of the same code).

Using the website transfers no rights to you other than the right of personal use under article 4.

Article 9. Suspension and closure of an account

We may suspend or close an account only for a breach of these Terms of Use (account sharing, scraping or distributing content, bypassing access limits, harming the operation of the website).

  • The measure is proportionate to the breach.
  • Except in an emergency or for a serious breach (for example large-scale scraping in progress or an attack on the website), we first warn you by email, stating the breach, and give you a reasonable time to stop it or explain yourself.
  • You are told by email of the measure taken and the reason for it. You may challenge it in writing at contact@infraprep.fr, then refer the matter to the consumer mediator or to the courts (article 12 of the Terms of Sale).
  • If we close a subscriber's account following a serious breach, the subscription is terminated; the financial consequences are those set by law and the Terms of Sale. [TO BE VALIDATED BY THE REVIEWER: treatment of the current period when an account is closed for a breach.]

We may also temporarily interrupt the website for maintenance or security.

Article 10. Personal data and cookies

How we process your data is described in the Privacy Policy, and cookies in the Cookie Policy.

Article 11. Changes to these Terms of Use

We may change these Terms of Use, for example to follow changes to the website or the law. If you have an account, we inform you by email of any significant change at least 30 days before it applies. A change cannot reduce the rights attached to a current subscription without your consent; changes to the subscription conditions follow article 15 of the Terms of Sale. If you do not accept the new Terms of Use, you may close your account and cancel your subscription free of charge.

Article 12. Governing law and disputes

These Terms of Use are governed by French law, without depriving you of the protection of the mandatory provisions of the law of your country of residence in the European Union. The rules on complaints, mediation and jurisdiction are those in articles 12 and 14 of the Terms of Sale.
